Wetland delineations are often a critical part of any landowner's decision on land use. Recognizing the potential for continued or accelerated degradation of the nation's waters, the United States Congress enacted the Clean Water Act ("Act"). Under the Act, excavating or placement of any material in low areas or wetlands requires approval by regulatory agencies. If you are planning a development project, you must know precisely the boundaries of wetlands on the property as determined through procedures specified in state and federal rules. A wetland delineation establishes the boundary between wetlands and uplands (or non-wetlands) by assessing whether the characteristics of wetlands (e.g. vegetation, soil and hydrology), are present on the site.
